These Terms & Conditions (“Terms”) govern your use of BeatCycle Ltd’s services, website, applications, and products (collectively referred to as “Services”). By accessing or using our Services, you agree to comply with these Terms.

Definitions

  • “Studio”: Refers to BeatCycle Ltd, the indoor cycling facility.
  • “Participant”: Refers to any individual using our Services.
  • “Instructor”: Refers to authorised personnel leading cycling classes.
  • “You” or “Your”: Refers to the Participant.
  • “User Account”: The online platform where participants manage bookings, credits, and memberships.
  • “Credits”: Class passes purchased through our platform, used for booking classes.
  • “Membership”: A subscription plan entitling members to a set number of credits per month.

1. Assumption of Risk & Health

a) Assumption of Risk: Participation in indoor cycling classes involves inherent risks, including but not limited to physical injury. By using our Services, you voluntarily assume all risks associated with participation. Prior to being able to participate, you must sign the Health & Safety Waiver & Release.

b) Health Considerations: Participants affirm that they are in good physical health and have no medical conditions that would prevent safe participation. Please refer to the Health & Safety Waiver & Release for further details.

c) Health & Safety Compliance: Instructors and staff are not medically qualified. If you have any doubts about your fitness to participate, we strongly recommend you consult a doctor before attending classes. If you feel unwell, please do not attend class

2. Booking & Cancellation

a) Reservations: Classes must be booked via our website or mobile application.

b) Cancellation Policy:

   i) Classes can be cancelled up to 6 hours before the scheduled start time for a refund or credit return.

   ii) If a class is cancelled less than 6 hours before the start time or missed, the class credit will be deducted from your package or membership.

   iii) an early morning class, please cancel by 9pmthe night before to not incur any penalties.

   iv) Late cancellations may be subject to an additional cancellation fee.

3. Waitlist Policy

   i) If a space becomes available, waitlisted participants are automatically assigned in order.

   ii) If assigned a spot, a class credit will be deducted, and the standard cancellation policy will apply.

   iii) If added to a class from the waitlist less than 2 hours before the class start time, you must confirm your spot within a set timeframe. Failure to confirm may result in forfeiting the spot.

4. Code of Conduct

a) Respect & Behaviour: All participants must treat instructors, staff, and fellow members with respect and courtesy.

b) Adherence to Instructions: Participants must follow instructor guidance and comply with studio rules.

 c) Studio Etiquette: Late arrivals may not be permitted to join a class once it has started. Mobile phone use during classes is prohibited to ensure an optimal experience for all participants.

5.Equipment & Facilities

a) Equipment Use: Studio equipment must be used safely and as instructed. Any misuse may result in restricted access.

b) Facility Rules: Participants must adhere to all posted facility rules and regulations.

c) `Personal Belongings: BeatCycle Ltd is not responsible for loss, theft, or damage to personal property.

d) Hygiene & Cleanliness: Equipment is sanitised regularly, and participants must wipe down their bikes after use. Hand sanitisation stations are available in all studio areas.

e) Emergency Procedures: In case of an emergency, staff will assist and contact emergency services if necessary. Participants must follow all emergency evacuation procedures.

6. Liability & Waiver

a) Liability Release: By using our Services, you agree to the terms of the Health & Safety Waiver & Release, and release BeatCycle Ltd and its representatives from liability for any injuries, damages, or losses incurred in accordance with its terms and to the maximum extent permitted by law.

 b) Personal Injury Disclaimer: While we take precautions to ensure a safe environment, BeatCycle Ltd is not liable for injuries sustained due to improper use of equipment or failure to follow safety guidelines, in accordance with the terms of the Health & Safety Waiver & Release and to the maximum extent permitted by law.

7. Privacy & Data Protection

a) Data Usage: Personal data is collected and used per our Privacy Policy. By using our Services, you consent to this data usage.

b) Account Security: You are responsible for maintaining the confidentiality of your User Account login details. You must notify us immediately of any unauthorized access.

8. Membership Terms & Conditions

a) Membership Duration & Payments:

   i) Memberships are for a 3-month period, payable monthly at the rate specified at the time of purchase.

 b) Cancellation of Membership:

   i) Early termination of a 3-month contract requires 1 months’ written notice.

   ii) After 3 months, membership will automatically roll over and require 1 month’s written notice for cancellation.

   iii) Members may pause their membership up to twice per year, with prior written notice.

c) Membership Benefits & Guest Passes:

   i) Monthly memberships include one guest pass per month.

9. Class Pack Terms & Conditions

a) Class Pack Validity:

   i) 5-Class Pack: Valid for 6 weeks from purchase date.

   ii) 10-Class Pack: Valid for 10 weeks from purchase date.

   iii) 20-Class Pack: Valid for 5 months from purchase date.

b) Refunds & Transfers:

   i) Class packages are non-refundable and non-transferable.

   ii) Expired credits cannot be reinstated unless under exceptional circumstances at our sole and absolute discretion.

c) Special Credits & Promotions:

   i) Certain classes or events may require Special Credits, which differ from standard class credits.

   ii) Promotional credits may have a shorter expiration period; terms will be communicated at purchase.

10. Cooling-Off Period

   i) Customers who purchase memberships or class packs online are entitled to a 14-day cooling-off period.

   ii) If no classes have been attended, a full refund will be issued upon cancellation.

   iii) If classes have been used, the refund amount will be reduced based on the value of the classes attended.

11. Governing Law & Jurisdiction

These Terms are governed by English law. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

  • By using our Services (including our website or application), you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, you must not use our Services, website or application.

  • We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.
  • You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our site or any part of it. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site or any other equipment or network connected with our site. You must not interfere with, damage or disrupt any software used in the provision of our site or any equipment or network or software owned or used by any third party on which this site relies in any way. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990.
